Welcome to California Shop Diesel.
These Terms of Service govern your use of this website and any purchases, products, information, content, features, tools, and services offered through it.
The terms “California Shop Diesel,” “we,” “us,” and “our” refer to California Diesel MFG LLC, doing business as California Shop Diesel.
Our online store is powered by Shopify, which provides the ecommerce platform that allows us to offer products and services to you.

SECTION 2 — PRODUCTS, PART NUMBERS AND APPLICATION INFORMATION
California Shop Diesel sells diesel fuel-system components and related automotive products, which may include new, remanufactured, rebuilt, aftermarket, OEM, exchange, and other components.
We make reasonable efforts to provide accurate product descriptions, photographs, specifications, part numbers, interchange information, and application information.
However, vehicle and engine applications may vary by production date, engine configuration, emissions specification, calibration, manufacturer updates, or other factors.
Customers are responsible for verifying part numbers and compatibility before installation.
When appropriate, we recommend confirming compatibility using the original part number, VIN, engine serial number, calibration code, or other relevant vehicle information.
Photographs may be representative, and minor visual differences may exist between the product received and images displayed on the website.
Product descriptions, specifications, availability, and pricing may be corrected or changed without notice.
SECTION 3 — ORDERS
Submitting an order constitutes an offer to purchase.
An automated order confirmation, payment authorization, payment confirmation, or other automated communication does not necessarily constitute final acceptance, review, processing, or shipment of an order.
We reserve the right to accept, reject, cancel, or limit an order where reasonably necessary, including because of product availability, pricing or listing errors, suspected fraud, payment authorization issues, shipping restrictions, incorrect product information, unusually large quantities, export restrictions, technical errors, or other legitimate business reasons.
If an order is canceled after payment has been collected, any amount properly due back to you will be refunded to the applicable payment method.
Please review your order carefully before submitting it.
Once an order has entered processing, fulfillment, rebuilding, programming, customization, or shipment, cancellation may no longer be possible, subject to applicable law.
Returns and exchanges are governed by our Return & Refund Policy.
SECTION 4 — COMMERCIAL AND BUSINESS PURCHASES
California Shop Diesel serves both individual customers and commercial purchasers.
Our products may be purchased for personal, commercial, fleet, repair, resale, or other lawful business purposes unless a particular product or transaction states otherwise.
Purchasers are responsible for complying with any laws, licensing requirements, export controls, resale requirements, tax obligations, and other regulations applicable to their purchase or use of the products.
SECTION 5 — PRICES, TAXES AND BILLING
Prices, discounts, promotions, and product availability may change without notice.
The applicable product price will generally be the price displayed at the time the order is submitted, subject to correction of genuine errors.
Applicable sales tax, shipping, handling, customs duties, import fees, brokerage charges, core charges, or other transaction-specific charges may be added where applicable and as permitted by law.
You agree to provide accurate and authorized billing and payment information.
You represent that you are authorized to use any payment method submitted for your purchase.
SECTION 6 — SHIPPING AND DELIVERY
Orders and deliveries are subject to our Shipping Policy.
Processing time and carrier transit time are separate.
Delivery dates and transit times are estimates unless we expressly guarantee a particular date in writing.
Carrier delays, weather, customs processing, transportation disruptions, government actions, natural disasters, labor disruptions, technical failures, and other circumstances outside our reasonable control may affect delivery.
Nothing in this section eliminates any shipment, cancellation, refund, or delivery right that cannot legally be waived.
SECTION 7 — SYSTEM OUTAGES, PLATFORM INTERRUPTIONS AND SERVICE AVAILABILITY
California Shop Diesel relies on third-party technology and service providers to operate portions of the Services. These may include ecommerce platforms, payment processors, hosting and infrastructure providers, internet and telecommunications providers, shipping systems, communications systems, applications, fraud-prevention services, and other technology providers.
Technical failures, maintenance, cybersecurity incidents, service interruptions, account-access restrictions, synchronization failures, software errors, telecommunications failures, or other events outside our reasonable control may temporarily prevent or delay our ability to access, review, verify, confirm, process, fulfill, modify, cancel, or communicate regarding orders and transactions.
An order or payment may in some circumstances be submitted or processed by a third-party system while California Shop Diesel is temporarily unable to access the systems necessary to view or process that transaction.
If this occurs, processing and fulfillment may be delayed until we regain reasonable access to the systems and information necessary to verify the transaction.
A payment authorization, payment confirmation, automated order confirmation, or other automated notification does not by itself establish that an order has been manually reviewed, processed, fulfilled, or shipped.
Once access is restored, we will make reasonable efforts to identify and process affected transactions as promptly as practicable.
If an affected order cannot be fulfilled within an applicable promised shipping period, we will provide any notice, cancellation opportunity, refund, or other remedy required by applicable law.
We do not guarantee that the website, checkout, customer accounts, payment systems, order-management systems, communications systems, or other Services will be continuously available or completely free from interruptions or technical errors.
California Diesel MFG LLC is not responsible for delays caused solely by independent third-party platform or technology failures outside our reasonable control, except to the extent responsibility cannot legally be excluded or limited.
Nothing in this section eliminates a customer's right to receive merchandise purchased and paid for or to receive a refund, cancellation right, or other remedy where required by applicable law.
SECTION 8 — INSTALLATION, DIAGNOSIS AND VEHICLE CONDITION
Diesel fuel-system components are precision components.
Product performance may be affected by circumstances unrelated to the purchased component, including fuel contamination, metal debris, water or other contamination, incorrect installation, electrical faults, damaged wiring, incorrect diagnosis, fuel-pressure problems, pump failure, calibration or programming issues, improper torque or installation procedures, failure to replace required supporting components, or other engine or vehicle conditions.
Customers and installers are responsible for following applicable manufacturer specifications and professional installation procedures.
Installation of a product does not by itself establish that the product was defective.
Likewise, continuation of an existing vehicle symptom after installation does not by itself establish product failure.
Products alleged to be defective after installation may be subject to inspection or testing under the applicable warranty procedures.
SECTION 9 — PROFESSIONAL INSTALLATION
Certain products may require specialized tools, calibration, programming, testing, cleanliness standards, or installation procedures.
Unless expressly stated otherwise, California Shop Diesel recommends that diesel injection and fuel-system components be installed by a qualified professional familiar with the applicable system.
California Diesel MFG LLC is not responsible for damage caused by improper installation, incorrect diagnosis, contamination, misuse, unauthorized modification, or failure to follow applicable installation procedures, except to the extent liability cannot legally be excluded.
SECTION 10 — RETURNS, CORES AND WARRANTY CLAIMS
Returns are governed by our Return & Refund Policy.
Installed or used products claimed to be defective generally must be evaluated as warranty claims rather than ordinary returns.
Certain exchange or remanufactured products may require return of an acceptable core.
Core requirements, deadlines, credits, and eligibility requirements may be stated on the applicable product page, invoice, order confirmation, or accompanying documentation.
Nothing in these Terms limits any warranty or consumer remedy that cannot legally be excluded.
SECTION 11 — WARRANTIES
Any written warranty provided by California Shop Diesel for a particular product will be governed by the terms of that warranty.
Products manufactured by third parties may also be subject to manufacturer warranties.
Warranty coverage may vary depending on the product.
Except where expressly stated in an applicable written warranty, and only to the maximum extent permitted by applicable law, no additional warranty is created merely through website descriptions, photographs, technical information, compatibility information, advertising statements, or communications.
Nothing in these Terms is intended to disclaim, limit, or modify an implied warranty or statutory consumer right where such disclaimer, limitation, or modification is prohibited by law.
SECTION 12 — INTELLECTUAL PROPERTY
The content of the Services, including text, graphics, logos, photographs, product images, videos, designs, software, layout, and other materials, may be owned by California Diesel MFG LLC, Shopify, licensors, manufacturers, suppliers, or other rights holders.

Unless expressly permitted, you may not copy, reproduce, republish, modify, distribute, scrape, commercially exploit, or create derivative works from proprietary website content without authorization.

California Shop Diesel is powered by Shopify, which enables us to provide the ecommerce Services to you.
However, sales and purchases made through California Shop Diesel are transactions directly with California Diesel MFG LLC, unless expressly stated otherwise.
Shopify provides technology and infrastructure for the online store but is not the seller of California Shop Diesel products.
To the extent permitted by applicable law, Shopify and its affiliates are not responsible for products sold by California Diesel MFG LLC or for our fulfillment of customer transactions.
SECTION 16 — PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Shopify and other service providers may also process personal information as necessary to provide ecommerce, payment, analytics, security, fraud-prevention, shipping, and related services.

Where permitted by law, we may cancel an order affected by a material pricing, inventory, technical, or listing error and refund amounts paid for the canceled item.

We reserve the right to suspend or terminate access when reasonably necessary to protect California Diesel MFG LLC, our customers, Shopify, our systems, or third parties.

Termination does not eliminate obligations that arose before termination.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CALIFORNIA DIESEL MFG LLC AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THEM, INCLUDING LOST PROFITS, LOST BUSINESS, LOSS OF USE, LOSS OF DATA, TOWING EXPENSES, RENTAL EXPENSES, VEHICLE DOWNTIME, BUSINESS INTERRUPTION, OR SIMILAR CONSEQUENTIAL LOSSES.
THIS LIMITATION DOES NOT APPLY WHERE LIABILITY CANNOT LEGALLY BE EXCLUDED OR LIMITED.
NOTHING IN THESE TERMS EXCLUDES LIABILITY FOR FRAUD, INTENTIONAL MISCONDUCT, OR ANY OTHER LIABILITY THAT CANNOT LEGALLY BE EXCLUDED.
SECTION 24 — INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold California Diesel MFG LLC harmless from third-party claims arising from your unlawful use of the Services, violation of these Terms, infringement of third-party rights, or misuse of products.
This provision does not require a consumer to indemnify California Diesel MFG LLC for our own unlawful conduct or for obligations that cannot legally be shifted or waived.
SECTION 25 — SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will remain in effect.
SECTION 26 — WAIVER AND ENTIRE AGREEMENT
Failure to enforce any provision of these Terms does not waive our right to enforce that provision later.
These Terms, together with policies incorporated by reference and applicable product-specific terms, constitute the agreement governing your use of the Services.
SECTION 27 — ASSIGNMENT
You may not assign your rights or obligations under these Terms without our prior written consent, except where applicable law provides otherwise.
California Diesel MFG LLC may assign its rights and obligations in connection with a merger, acquisition, reorganization, sale of assets, financing, or other legitimate business transaction, subject to applicable law.
SECTION 28 — GOVERNING LAW
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where federal law or another jurisdiction's mandatory consumer-protection laws apply.
Subject to any mandatory consumer rights regarding venue or jurisdiction, disputes arising from these Terms or transactions with California Shop Diesel will be handled in courts of competent jurisdiction serving Riverside County, California.
Nothing in this section deprives a consumer of rights regarding jurisdiction or venue that cannot legally be waived.

Section headings are provided for convenience and organization only and do not change the meaning of these Terms.
SECTION 30 — CHANGES TO THESE TERMS
We may update these Terms periodically.
The current version will be posted on this website.
Material changes will take effect in accordance with applicable law.
Your continued use of the Services following an effective update constitutes acceptance of the revised Terms to the extent permitted by law.
